Richard D. Webb appeals from his convictions for second degree burglary and second degree malicious mischief, contending that the trial court erred by admitting into evidence his statement to police and his alleged statement to his then-wife, and by refusing to submit his proposed jury instruction. Webb also appeals his sentence, asserting that his second degree burglary and second degree malicious mischief convictions encompassed the same criminal conduct for purposes of calculating his offender score under the Sentencing Reform Act of 1981 (SRA). We affirm the conviction, but remand for resentencing.
